Fox Travel Technologies Pte. Ltd. – Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of the websites, booking platforms, and digital services operated by Fox Travel Technologies Pte. Ltd. (“FTT”, “we”, “our”, or “us”), including www.ftt.com.sg, RedFox Travel and, Elevated Journeys (collectively, the “Platforms”). By using our Platforms or services, you (“User”, “Agent”, “Partner”, or “Customer”) agree to be bound by these Terms, which constitute a legally binding agreement between you and FTT. If you do not agree, you should discontinue use of our Platforms immediately.

1. Scope and Eligibility

These Terms apply to all users of FTT’s Platforms, including travel agents, suppliers, partners, and end customers. Access to our Platforms is conditional upon your acceptance of these Terms and our Privacy & Cookie Policy, available at www.ftt.com.sg/privacy.

2. Services

FTT provides B2B services, including hotel bookings, attractions, transfers, and other travel-related products offered through our brands and technology platforms. Services are subject to availability and may be modified, suspended, or discontinued at FTT’s discretion without prior notice.

3. Account Registration and Security

Authorized users may be required to create an account with an assigned ID and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. FTT shall not be liable for unauthorized access or misuse of your credentials.

4. Use Restrictions

You agree not to:
(a) reproduce, modify, distribute, or create derivative works of our Platforms;
(b) use automated systems or bots to access data;
(c) engage in unlawful, fraudulent, or abusive conduct;
(d) share FTT’s rates or inventory with B2C channels without prior written consent; or
(e) use the Platforms to distribute spam or harmful content.

5. Payments and Pricing

All prices are quoted in the currency specified at the time of booking. Payments must be made using approved methods (Visa, Mastercard, or other accepted forms). Pricing is dynamic and may vary depending on supplier rates or exchange fluctuations. FTT reserves the right to correct any errors or inaccuracies in pricing at any time without prior notice.

6. Bookings, Cancellations, and Refunds

Bookings made through our Platforms are subject to the specific terms of each product. Cancellation and refund policies vary by supplier and will be displayed prior to confirmation. No-shows are treated as cancellations with no refund. Refunds, if applicable, will be processed using the original payment method within a reasonable time frame.

7. Data Privacy

FTT complies with the Singapore Personal Data Protection Act (PDPA). By using our Platforms, you consent to the collection, use, and disclosure of your personal data in accordance with our Privacy & Cookie Policy. You are responsible for ensuring that any personal data shared with us has been lawfully obtained and consented by the data subject.

8. Intellectual Property

All intellectual property rights in the Platforms, including software, content, text, images, logos, and designs, are owned or licensed by FTT. You may not reproduce or use our materials for commercial purposes without prior written consent.

9. Limitation of Liability

The Platforms and services are provided on an “as is” and “as available” basis. FTT disclaims all warranties, express or implied. To the maximum extent permitted by law, FTT shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total aggregate liability shall not exceed the total fees paid by you in the preceding three (3) months.

10. Indemnification

You agree to indemnify, defend, and hold harmless FTT, its directors, officers, employees, and affiliates against any claims, damages, or expenses (including legal fees) arising from your breach of these Terms, misuse of the Platforms, or violation of any applicable law.

11. Termination

FTT reserves the right to suspend or terminate your account or access to any Platform at any time without notice if you breach these Terms, misuse the system, or engage in any fraudulent or harmful activity. Upon termination, your right to access the Platform ceases immediately.

12. Force Majeure

Neither party shall be liable for failure to perform obligations under these Terms due to events beyond their reasonable control, including acts of God, war, natural disasters, strikes, or regulatory actions. Performance will resume once the force majeure event ceases.

13. Amendments

FTT may update or modify these Terms from time to time. Updates will be posted on our website, and continued use of the Platform after publication constitutes acceptance of the revised Terms.

14. Independent Contractor Relationship

FTT and its users are independent contractors. Nothing in these Terms shall create a partnership, joint venture, or employment relationship between the parties.

15. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the SIAC Rules in force at the time of the dispute. The seat of arbitration shall be Singapore, and proceedings shall be conducted in English.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. You agree to submit to the exclusive jurisdiction of the Singapore courts for any matters not subject to arbitration.
